欧州特許出願の更新手数料(維持年金)の支払いは、欧州特許の付与公告により、その義務を負う必要がなくなります。
EPC Article 86 (2)
The obligation to pay renewal fees shall terminate with the payment of the renewal fee
due in respect of the year in which the mention of the grant of the European patent
is published in the European Patent Bulletin.
公告日は、クレームの翻訳文と料金を納付した後に通知される、
“Decision to grant a European patent pursuant to Article 97(1) EPC”に記載されています。
具体的には、以下の部分に公告日が記載されています。
The mention of the grant will be published in European Patent Bulletin ●●/○○ of 公告日.
公告日は、”Decision to grant a European patent”の通知からおよそ１ヶ月後です。
