米国の先発明主義は限定的→先使用権が必要(制度は不十分)

日本では、特許法79条に先使用権が規定されており、先に発明をして実施又は準備をしている者は、他者が特許を取得しても、その実施を継続することができます。この規定は、先願主義を採用したことによる、先発明者の不利益を低減するためのものであると説明されています。

(先使用による通常実施権)
第79条 特許出願に係る発明の内容を知らないで自らその発明をし、又は特許出願に係る発明の内容を知らないでその発明をした者から知得して、特許出願の際現に日本国内においてその発明の実施である事業をしている者又はその事業の準備をしている者は、その実施又は準備をしている発明及び事業の目的の範囲内において、その特許出願に係る特許権について通常実施権を有する。


このような趣旨を考えると、先発明主義を採用している米国では先使用権は必要ないように思えますが、実際は、ビジネス方法に限定して、以下のように規定されています。(1)ビジネス方法であること、(2)出願日の一年以上前に具現化していること、(3)出願時に商業化していること、が要件です。非常に限定されていることが分かります。


35 U.S.C. 273 Defense to infringement based on earlier inventor.
(a) DEFINITIONS.- For purposes of this section-
(3) the term “method” means a method of doing or conducting business; and
(b) DEFENSE TO INFRINGEMENT.-
(1) IN GENERAL.- It shall be a defense to an action for infringement under section 271 of this title with respect to any subject matter that would otherwise infringe one or more claims for a method in the patent being asserted against a person, if such person had, acting in good faith, actually reduced the subject matter to practice at least 1 year before the effective filing date of such patent, and commercially used the subject matter before the effective filing date of such patent.


先発明主義の米国でどうして先使用権が必要なのか?
まず、「先発明主義」の意味について考えると、先発明主義とは、後に発明して先に出願した者がいても、先に発明したものに権利が与えられる制度であると言えます。この制度は、具体的には、次の条文で具現化されています。この条文中、not abandoned, suppressed, or concealedの部分が重要です。先発明主義が適用される前提として、「発明が放棄されたり、隠されたりしていないこと」が要件になっています。従って、ノウハウとして隠した発明については、先発明主義が適用されないことになり、先願者に特許が付与されてしまします。このような、先発明主義の制限のために、米国でも先使用権が必要になっていますが、先使用権の範囲は上記の通り、非常に限られています。
35 U.S.C. 102 Conditions for patentability; novelty and loss of right to patent.
(g)(1) during the course of an interference conducted under section 135 or section 291, another inventor involved therein establishes, to the extent permitted in section 104, that before such person’s invention thereof the invention was made by such other inventor and not abandoned, suppressed, or concealed, or (2) before such person’s invention thereof, the invention was made in this country by another inventor who had not abandoned, suppressed, or concealed it. In determining priority of invention under this subsection, there shall be considered not only the respective dates of conception and reduction to practice of the invention, but also the reasonable diligence of one who was first to conceive and last to reduce to practice, from a time prior to conception by the other.
