米国で特許の有効性を争う制度の問題点(reexam→文献に基づく無効主張のみ 訴訟→clear and convincing evidence)

米国で特許の有効性を争うには、再審査請求(request for reexamination)と、訴訟での無効の主張が(invalidity contention)あります。
再審査請求には、査定系(ex parte)と当事者系(inter parte)があり、それぞれにメリットとデメリットがあります。別の機会に詳しく書きます。
訴訟では、特許を無効にするためには、”clear and convincing evidence”(明確かつ説得力のある証拠)が要求されます。従って、本来特許になるべきでなかったような発明でも一旦特許になってしまうと無効にすることが非常に難しいことになります。
一方、再審査では、”preponderance of the evidence”(証拠の優越)の証拠で特許を無効にすることができます。しかし、再審査請求では、特許又は印刷刊行物に基づく無効理由しか主張することができません。
従って、On-saleなどの規定による特許無効を主張する場合や、記載不備に基づく特許無効の主張は、再審査では行うことができず、訴訟で争うしかありません。一方、上記の通り、訴訟では、”clear and convincing evidence”が要求されます。
このように、米国では、一旦特許になってしますと、審査時と同じ基準でon-saleや記載不備に基づく特許性の有無を争うことができないので、特許になるべきでない発明でも有効に特許として成立してしまいます。

35 U.S.C. 301 Citation of prior art.
Any person at any time may cite to the Office in writing prior art consisting of patents or printed publications which that person believes to have a bearing on the patentability of any claim of a particular patent. If the person explains in writing the pertinency and manner of applying such prior art to at least one claim of the patent, the citation of such prior art and the explanation thereof will become a part of the official file of the patent. At the written request of the person citing the prior art, his or her identity will be excluded from the patent file and kept confidential.
35 U.S.C. 302 Request for reexamination.
Any person at any time may file a request for reexamination by the Office of any claim of a patent on the basis of any prior art cited under the provisions of section 301 of this title. The request must be in writing and must be accompanied by payment of a reexamination fee established by the Director pursuant to the provisions of section 41 of this title. The request must set forth the pertinency and manner of applying cited prior art to every claim for which reexamination is requested. Unless the requesting person is the owner of the patent, the Director promptly will send a copy of the request to the owner of record of the patent.
