米国では特許を無効にするには”Clear and Convincing”な証拠が必要

日本では、特許になる前となった後で特許性の基準は変わりません。現実には、特許庁も裁判所も一旦特許にしたものを無効にすることには躊躇するでしょうから、特許になる前に拒絶に導く方が特許を無効にするよりも容易ですが、少なくとも法律上は特許になる前となった後で特許性の基準は変わりません。
米国では、以下の規定により,特許の有効性が働きますので、特許になる前となった後では、特許性の基準が異なります。
特許になる前に拒絶するには、”preponderance of the evidence”(証拠の優越)の証拠があればいいと考えられています。つまり、拒絶の心証が拒絶でない心証よりも強ければ、それでOKです。
一方、特許になった後は、”clear and convincing evidence”(明確かつ説得力のある証拠)が必要であるとされています。つまり、拒絶の心証が強いだけでは不十分で、それが明確でなければなりません。

§282. Presumption of validity; defenses

A patent shall be presumed valid. Each claim of a patent (whether in independent, dependent, or multiple dependent form) shall be presumed valid independently of the validity of other claims; dependent or multiple dependent claims shall be presumed valid even though dependent upon an invalid claim. Notwithstanding the preceding sentence, if a claim to a composition of matter is held invalid and that claim was the basis of a determination of nonobviousness under section 103(b)(1) [35 USC 103(b)(1)], the process shall no longer be considered nonobvious solely on the basis of section 103(b)(1) [35 USC 103(b)(1)]. The burden of establishing invalidity of a patent or any claim thereof shall rest on the party asserting such invalidity.
この規定があるために、米国では、くだらない特許でも簡単には無効になりません。
この規定は、権利の安定性という意味では意味があるものですが、企業の特許の強さが、どの審査官によって審査されるかによって大きく影響されてしまうという問題があります。つまり、平均的な審査官であれば特許にならない発明がたまたま甘い審査官にあたって特許になってしまえば、その特許は簡単には無効にならないので、その特許の保有者は、偶然の要素によって業界で強い地位を占めてしまうことになりかねません。
特許の有効性が推定される根拠は、特許の専門家である審査官が厳格な審査を行った結果、特許が発行されるということにあります。そうすると、審査官が考慮してしなかった文献について特許の有効性が推定されるべきかどうかという点が論点になります。
以下の記事は、審査官が考慮してしなかった文献については、特許の有効性が推定を緩くして、特許を無効にするための基準を低くすべきであると、Microsoftが最高裁に申し出たという内容です。

なお、最高裁は、KSR事件で、以下のように述べて、審査官が考慮していない文献については、特許の有効性が緩まると述べていますので、このような文献に基づく無効主張のための証拠の基準も緩めるべきだと判断する可能性もあると思います。
