アメリカでは出願時に発明者または出願人のサインが必要な書類が3つあります。
AIA新法における提出期限や追完費用をまとめておきます。
(1) 宣言書 (Declaration)
サインする者： 発明者
提出期限： 登録料納付まで ※
追完費用： $140
(2) 譲渡証 (Assignment)
サインする者： 発明者
提出期限： 特になし
・係属中に出願の承継があった場合は、委任状の提出時に発明者から原出願人までのChain of Title（譲渡履歴）の譲渡証がすべて提出されている必要がある
追完費用： なし
(3) 委任状 (Power of Attorney)
サインする者： 出願人
・譲受人(企業等)が出願人となるケースでは企業等の承認権を持った者が署名
・発明者が出願人となるケースでは、発明者が署名
提出期限： 特になし
・Terminal Disclaimer提出、インタビュー実施等では委任状の提出が必要となるので、早めの提出が好ましい
・代理人を変更する場合は新しい代理人への委任状提出が必須
追完費用： なし

602.01(a) Inventor’s Oath or Declaration in Application Filed On or After September 16, 2012 [R-07.2015]
(f) TIME FOR FILING.—The applicant for patent shall provide each required oath or declaration under subsection (a), substitute statement under subsection (d), or recorded assignment meeting the requirements of subsection (e) no later than the date on which the issue fee is paid.
