米国特許法改正　先使用権の施行日について

Section 5の(c)に施行日が規定されており、「この法律の施行日又はその後に発行された特許に対して適用される」と規定されているので、2011/9/16以降に発行された特許に適用されると思います。
改正法条文
Section 5
(c) EFFECTIVE DATE.―The amendments made by this section
shall apply to any patent issued on or after the date of the enactment of this Act.
