What happens if the response deadline is missed?

At the examination stage, an extension of two months is available if a request is filed within two months from the day after the deadline (no reason required, JPY 4,200, one request only). However, this is not available if a written opinion was already filed within the response period, for notices dispatched on or after 1 January 2022. If only an amendment was filed and no written opinion, the extension is still available.
At the appeal stage, no extension is available after the deadline.

Q4. Can the response period be extended at the appeal stage?

Yes, but only by one month, and only for foreign applicants (JPY 2,100). No specific reason needs to be stated. The maximum response period is four months. Unlike the examination stage, no extension is available once the deadline has passed, so deadlines at the appeal stage must be managed carefully.

Q5. Can the period for filing an appeal against a decision of refusal be extended?

No. The period is three months from the day after the certified copy of the decision is served, and it cannot be extended, even for foreign applicants. In patent cases the JPO automatically adds one month for foreign applicants, making the period four months, but there is no equivalent for trademarks. Applying the patent rule to a trademark case would create a one-month error on a deadline that cannot be recovered.

Please note that this article is based on the information available and the applicable laws and regulations in effect as of the date of publication.
