To meet this need, the Japan Patent Office (JPO) offers several systems that accelerate examination and prosecution for patent, utility model, design, and trademark applications.<\/p>\n<p>In this article, SKIP explains the key fast\u2011track systems, their requirements, and how applicants can strategically utilize them.<\/p>\n<hr>\n<p><strong><span>Patents &amp; Utility Models<\/span><\/strong><\/p>\n<p>Some patent filings require rapid acquisition of rights\u2014whether to support product launches, prevent counterfeits, or satisfy requirements for subsidies or certifications. For these situations, the JPO provides the <strong>Accelerated Examination<\/strong>, <strong>Accelerated Appeal Examination<\/strong>, and <strong>Prioritized Examination<\/strong> systems.<\/p>\n<p><strong><span>Accelerated Examination \/ Accelerated Appeal Examination<\/span><\/strong><\/p>\n<p>These systems allow qualifying applications to be examined faster upon the applicant\u2019s request. Eligible categories include:<\/p>\n<ul>\n<li><span>Applications by SMEs, individuals, and universities<\/span><\/li>\n<li><span>Applications with foreign counterparts<\/span><\/li>\n<li><span>Applications related to working (implementation)<\/span><\/li>\n<li><span>Green technology applications<\/span><\/li>\n<li><span>Applications contributing to disaster recovery<\/span><\/li>\n<li><span>Applications for advancing Asia\u2011based business initiatives<\/span><\/li>\n<\/ul>\n<p>In addition, if a third party is already practicing the invention commercially, the application may qualify for accelerated appeal examination.<\/p>\n<p><strong><span>Super Accelerated Examination<\/span><\/strong><\/p>\n<p>The fastest system offered by the JPO, Super Accelerated Examination conducts the first office action within approximately <strong>one month<\/strong> of request, and the second action within one month after responses are filed.<\/p>\n<p>Eligible applications must meet both of the following:<\/p>\n<ol>\n<li><span>The application is either (a) both implementation\u2011related and foreign\u2011related, or (b) a startup\u2019s application that is also implementation\u2011related.<\/span><\/li>\n<li><span>All procedures within the four weeks prior to the request were filed online.<\/span><\/li>\n<\/ol>\n<p><strong><span>Prioritized Examination<\/span><\/strong><\/p>\n<p>This system applies when a third party is already practicing the invention after publication of the application. To request prioritized examination, applicants must submit an explanation outlining:<\/p>\n<ul>\n<li><span>The applicant\u2019s own working of the invention<\/span><\/li>\n<li><span>Evidence of third\u2011party use and its impact<\/span><\/li>\n<li><span>A copy of any warning letter issued<\/span><\/li>\n<li><span>Documentation showing the third\u2011party implementation<\/span><\/li>\n<\/ul>\n<hr>\n<p><strong><span>Designs<\/span><\/strong><\/p>\n<p>Because designs frequently proceed to manufacturing and sales quickly, the risk of imitation increases before rights are granted. For this reason, accelerated examination systems are also available for design applications.<\/p>\n<hr>\n<p><strong><span>Trademarks<\/span><\/strong><\/p>\n<p>Trademark registration can take time, but in business, speed matters. The JPO therefore provides an accelerated process when applicants meet certain conditions, enabling faster acquisition of trademark rights.<\/p>\n<hr>\n<p><strong><span>Patent Prosecution Highway (PPH)<\/span><\/strong><\/p>\n<p>The Patent Prosecution Highway allows applicants to leverage a <strong>positive examination result<\/strong> in one jurisdiction to expedite examination in another.
